Professional Liability Insurance

Registered social workers require professional liability insurance coverage as outlined in the Health Professions Act. Insurance must be updated in your ACSW member profile annually. For RSWs who are employed, this requirement can be met through your employer’s liability insurance coverage. It is recommended, however, that RSWs obtain their own coverage.  ACSW does not specify a specific provider of professional liability insurance, but does require a minimum of $5 million in coverage that must include legal defense coverage.

What is professional liability insurance? 

Professional liability insurance provides both legal representation and protection from financial loss in the event of allegations and/or findings of breaches to the Standards of Practice or Code of Ethics arising from social work practice.

Why employer insurance is not enough 

It is important to understand the limitations of your employer’s professional liability coverage. Your employer’s liability insurance protects your employer. It might not protect you.

Employer insurance does not typically cover:

  • Legal representation at a discipline hearing tribunal
  • Representation or financial coverage of intentional acts of wrongdoing
  • Activities outside of scope of employment

You are encouraged to discuss professional liability coverage with your employer to fully understand the coverage provided to you through your employer and whether it meets the ACSW’s requirements as well as your own personal circumstances. Insurance coverage for many employers does not cover employees if there is disciplinary action and/or investigation by a regulator like ACSW.

While ACSW allows social workers to use their employer’s liability insurance, it is recommended that each RSW carry their own coverage.

Each social worker will have a unique set of circumstances, ask yourself the following questions and discuss coverage with an insurance provider and your employer to determine the right coverage for yourself.

Practicing as a volunteer

You might practice social work as a volunteer in addition to, or in place of, employment. As a volunteer, you also require professional liability insurance. You can provide your own liability insurance or the agency where you’re volunteering might provide it.

Supervising students

Professional liability insurance is important protection for social workers. You can also pay to include coverage to social work students that you supervise. During this critical stage in their learning journey, students may make mistakes. Insurance can protect a social worker and their student if a malpractice complaint results. Discuss professional liability insurance policies with your students’ educational institution.

Where to get professional liability insurance? 

Each social worker will have a unique set of circumstances, it is important to ensure your coverage meets the minimum required by the ACSW. Discuss your particular circumstances with an insurance professional to ensure you have the right amount of coverage. RSWs can purchase professional liability insurance from any reputable insurance provider. Professional associations (such as the Social Workers Association of Alberta) may offer insurance programs with preferred rates for association members.
